AF medical-marijuana dispensary rejected last week

A Phoenix zoning administrator rejected an attorney's arguments that a medical-marijuana dispensary should be allowed to open near Chandler Boulevard and 46th Street in Ahwatukee Foothills.

Neighbors, four schools and a pediatrician all made arguments against the dispensary, which were heard by Zoning Administrator Ray Jacobs on June 2.

Jacobs ruled in their favor and rejected the dispensary's application on June 10.

The dispensary was proposed by a company called Nowak Wellness Inc.

They have until June 28 to appeal the decision. If the decision is appealed it would go to the Phoenix Board of Adjustment.

Phoenix City Code states that dispensaries cannot be closer than 1,320 feet to a school or public community center.

Summit School of Ahwatukee, Horizon Community Learning Center, St. John Bosco Catholic School and Kyrene del Milenio Elementary School are all located near the proposed site.
