A company attempting to get a zoning variance through the city of Phoenix to open a medical marijuana dispensary in Ahwatukee Foothills will present its case to the city’s Board of Adjustment this Thursday.

The company, Nature’s Healing Center, is hoping the board will overturn a decision made by a zoning hearing officer in early June. The company needs a variance from the city in order to open the dispensary within 825 feet of Child Time Day Care and within 250 feet of a residentially-zoned area. The location they are looking at is at 4902 E. Warner Road, Suite 10.

Hearing Officer Teresa Hillner said she would not grant the zoning variance because there was nothing unique about the site at 4902 E. Warner Road, and there were no special circumstances that necessitated granting the variance.

Peter Valenzuela, chief executive officer of the Genesis Group Public Affairs, who is representing the owners of Nature’s Healing Center, said the site is unique because his client completed an exhaustive search of the Ahwatukee area and this was the only site with the correct zoning and a landlord willing to allow the use. 

Nature’s Healing Center was awarded the only license to open a dispensary in the Ahwatukee Foothills Community Health Analysis Area (CHAA). They cannot use that license to open outside of Ahwatukee. The state has set up a deadline for dispensaries to open by or lose their license, but Nature’s Healing Center is part of a lawsuit that has gotten them an extended time period.
